Fresh Psilocybe truffles are fully legal in the Netherlands and can be freely produced, traded, and sold. The product is classified as a food supplement according to European directives and complies with all applicable safety standards.

According to European guidelines, truffles are categorised under ‘herbs and botanicals’. The European Food Safety Authority (EFSA) considers mushrooms and truffles as botanicals. The hallucinogenic substances that give magic truffles their effect are listed in the Psychotropic Substances Convention, which means that possession of pure psilocybin is not allowed. Because these substances occur in many fungi, the United Nations has made an exception for these natural products. According to the Commentary on the Convention on Psychotropic Substances (Article 32, point 12), Peyote cacti, psilocybe mushrooms, and others are explicitly excluded from the convention, granting them legal status.
