Legal Status

Fresh Psilocybe truffles are fully legal in the Netherlands and can be freely produced, traded, and sold. The product is classified as a food supplement according to European directives and complies with all applicable safety standards.

According to European guidelines, truffles are categorised under ‘herbs and botanicals’. The European Food Safety Authority (EFSA) considers mushrooms and truffles as botanicals. EFSA notes: “Botanicals and derived preparations made from plants, algae, fungi, or lichens have become widely available on the EU market in the form of food supplements.”

Magic truffles (Psilocybe tampanensis) naturally grow out of the ground, and due to this process, the firmer and drier psychedelic fungus does not fall under the mushroom category and therefore is not covered by the mushroom law. This is why truffles are legal while mushrooms are not.

After several incidents with magic mushrooms in 2008 (primarily in Amsterdam), the Dutch government decided to make fresh magic mushrooms illegal. However, the law specifically refers to ‘De Paddestoel’ (mushroom). Legally, the “magic” psilocybin truffle is not a mushroom, but a mushroom substrate known as sclerotia.

Fresh Psilocybin Truffles Are Legal in the Netherlands

The hallucinogenic substances that give magic truffles their effect are listed in the Psychotropic Substances Convention, which means that possession of pure psilocybin is not allowed. Because these substances occur in many fungi, the United Nations has made an exception for these natural products. According to the Commentary on the Convention on Psychotropic Substances (Article 32, point 12), Peyote cacti, psilocybe mushrooms, and others are explicitly excluded from the convention, granting them legal status.

Legal Status

Possession of psilocybin mushrooms or psilocybin truffles is legal according to this treaty. Only when the psychoactive substances are extracted or synthesized does one violate current legislation.
